Garage Conversions In Oakland

Last updated

In Oakland a garage conversion is usually a Category One ADU, with no expansion except an entrance of up to 150 square feet. State law bars a city from requiring replacement parking when a garage becomes an ADU.

The Two-Step Process

The city says an application has two main steps: zoning approval, which checks location, size, and height, and a building permit, which checks that the unit is built safely and meets building codes. The same page estimates converting existing space such as a garage or basement at $200 to $300 per square foot.

Parking

The Oakland pages we read do not address replacement parking, but state law does. The HCD ADU Handbook (March 2026) says a local agency may not require off-street parking to be replaced when a garage, carport, or covered parking structure is converted to an ADU or demolished in connection with one (Government Code section 66314, subdivision (d)(11)). It also says a JADU cannot be required to provide parking, even when converted from an attached garage (Government Code section 66334).

What State Law Says About Conversions

The handbook says conversions are not subject to setback requirements, because they are created within an existing structure or built in the same location and to the same dimensions, and that a conversion's height is limited to the original structure. Conversions are still subject to building, health and safety, and fire standards for dwellings, and building an ADU cannot trigger a fire sprinkler requirement in the existing house (Government Code section 66314, subdivision (d)(12)).

Fire Zones

Oakland's single-family ADU page says creek areas and high-fire areas within the S-9 Zone have extra requirements. In a December 10, 2025 letter, HCD said the S-9 restrictions on ADUs are unchanged. See ADUs In Oakland for more.
